Brazil's nationwide gambling ban has become even less clear after a federal appeals court stopped an order that would have allowed the international betting company Stake to keep operating until October 25, 2026.

On October 9, the Federal Regional Court of the Third Region (TRF-3) overturned a lower court's decision that had temporarily protected Stake from some restrictions under Provisional Measure 1,394/2026.
This came just one day after the Ninth Federal Civil Court of São Paulo granted Stake temporary relief on October 8.
Federal appellate judge Luis Antonio Johonsom di Salvo sided with the government, explaining that allowing one gambling company to keep operating while others are banned could undermine consistent enforcement of government policy.

The ruling removes Stake's temporary legal protection while the main court case is still ongoing.
Importantly, the appellate court has not decided if Brazil's gambling ban is constitutional. The October 9 decision only considers whether Stake should get temporary protection during the legal process, not whether the ban follows Brazil's Constitution.
This distinction matters for Brazil's gambling industry. Operators now face immediate enforcement risks while courts debate broader legal questions about the government's gambling ban.

Why Brazil's Court Reversed Stake's Temporary Authorization

The main question is how emergency court protections affect the government's ability to apply a nationwide rule fairly to all companies.
Stake first received a temporary court order from the Ninth Federal Civil Court of São Paulo on October 8. This order would have allowed the company to keep some operations running until October 25, even though Provisional Measure 1,394/2026 introduced new restrictions.
The federal government quickly appealed the court order.

In the October 9 appeals decision, Judge di Salvo considered what would happen if only one company could keep operating while all other gambling businesses had to follow the ban.

The court stressed the need to apply national policy consistently. Giving one company an exemption could create unfair conditions during the enforcement period.
As a result, the appeals court put the lower court's order on hold until the main case is decided or another appeals decision changes the situation. This is a procedural win for the federal government, but it does not settle the bigger constitutional issue.

Stake's Existing Brazilian Gambling License Adds Another Legal Dimension

One key part of the case is that Stake already had permission to operate in Brazil's previously regulated betting market.
Stake Brazil received authorization under Ordinance SPA/MF No. 263/2025, issued by the Secretariat of Prizes and Betting within Brazil's Ministry of Finance. The authorization was originally scheduled to remain valid until December 31, 2029.
In the lower court, Stake asked for protection covering the full license period. However, the São Paulo court rejected that wider request and gave only temporary relief until October 25.

This dispute brings up a bigger question: how should the government treat businesses that got licenses, paid fees, and followed the rules before a new policy banned their activities?
Having a gambling license does not guarantee the rules will stay the same. Still, how existing licenses, deadlines, and investments are managed could become important issues in future court cases.
The October 9 appellate order does not fully answer those questions.

Brazil's Supreme Court Still Faces a Broader Constitutional Challenge

Although Stake's temporary court order has been suspended, the broader constitutional fight over Brazil's gambling ban continues.
Two industry organizations, the National Association of Games and Lotteries (ANJL) and the Brazilian Institute of Responsible Gaming (IBJR), have challenged the provisional measure before Brazil's Supreme Federal Court (STF).
Supreme Court Justice Luiz Fux is handling these cases. The associations want to overturn the measure that bans online gambling operations and advertising.

The legal challenges may raise several issues, including whether the federal government can impose broad restrictions through a provisional measure, how it treats businesses that already have licenses, and whether the transition period is fair.
These are possible topics for the court to review, not decisions the Supreme Court has made yet.

For international operators, the constituFor international operators, the Supreme Court case is much more important than Stake's individual dispute. A major ruling could clarify Brazil's betting laws and whether the ban can be enforced. remain in effect.

What the Stake Decision Means for Brazil's Gambling Industry

The latest court order highlights the immediate problems for companies that entered Brazil's regulated gambling market before the September 2026 ban.
The restrictions impact more than just casino websites and sports betting. Operators also depend on payment systems, tech suppliers, advertising partners, compliance teams, and staff to keep their services running.
Brazil's shutdown is already affecting player funds. Reports from October 9 say banks have started returning about R$1.325 billion from betting accounts, impacting around 26.5 million customers.

The size of these repayments shows how complex it is to close an established gambling market.
The Stake decision also signals to other operators considering legal action. Temporary court protection may be hard to keep when the federal government argues that exemptions weaken nationwide enforcement.

However, the ruling does not stop other companies from filing lawsuits, and it does not mean that every future injunction will be denied.
Each dispute will depend on its legal arguments, the specific situation, and the decisions of the courts involved.

Could Brazil's Gambling Ban Increase Offshore Casino Activity?

Another concern is whether the nationwide ban will stop people from gambling or just push them to use offshore operators.
Licensed gambling businesses follow rules that require identity checks, anti-money laundering controls, responsible gambling measures, and payment monitoring.
When a regulated market shuts down, some people may stop gambling completely. Others may try to use foreign websites that operate without local approval.
Without reliable data after the ban, it is hard to predict which outcome will be more common.
Brazilian industry representatives have warned that restrictions could push people toward illegal gambling services. These warnings reflect the industry's view, not independent proof of the ban's effects.

For regulators, the challenge goes beyond blocking licensed operators. Effective enforcement may also mean monitoring offshore websites, unauthorized ads, and payment channels that support illegal platforms.
It remains unclear whether Brazil's approach will reduce gambling or lead to more unregulated activity in 2027.

What Happens Next for Stake and Brazil's Gambling Market?

The October 9 decision takes away Stake's temporary legal protection, but it does not end the company's legal battle.
The suspension will stay in place until the main case gets a final decision or another appeals court changes the outcome.
The ruling should not be seen as a separate, immediate order to block Stake's website. It simply removes the legal protection against enforcement that Stake got the day before.

For the wider industry, three things will matter most: how the constitutional case moves forward in the Supreme Federal Court, how existing operator licenses are handled, and how restrictions on gambling websites and payments are implemented.

Brazil's experience could also serve as an example for other countries thinking about major changes to online gambling rules.
The main policy question is not just whether a government can set new restrictions. It is also about how to implement those restrictions when businesses already have licenses, have invested money, and have built relationships with millions of customers.

The Stake case shows that moving from a regulated gambling market to a nationwide ban can lead to legal disputes before courts even decide if the policy is constitutional.

For now, Stake has lost its temporary permission to operate, and the larger legal fight over Brazil's gambling ban is still not settled.

Is Stake still legally allowed to operate in Brazil?
Stake's temporary judicial protection was suspended by the Federal Regional Court of the Third Region on October 9, 2026. The company can no longer rely on the October 8 injunction to continue operations outside the nationwide restrictions.
Has Brazil's Supreme Court ruled that the gambling ban is constitutional?
No. The October 9 appellate decision did not determine the constitutionality of Provisional Measure 1,394/2026. Separate constitutional challenges remain before the Supreme Federal Court
Could Stake or other gambling operators challenge the ban again?
Yes. The suspension of Stake's injunction does not eliminate the possibility of further litigation. Operators and industry associations can pursue legal remedies, although the outcome of any future proceedings remains uncertain.
